Article 1. General Provisions and Scope

This Cookie Policy (hereinafter: the Policy) governs the manner in which Facility Management Services FMS DOOEL Skopje, with registered office at 20th October no.4, Skopje 1000, Republic of North Macedonia (hereinafter: the Company), uses cookies and related technologies on the website https://fms.mk/ (hereinafter: the website).

The Policy applies to all visitors to the website, regardless of their place of residence and regardless of whether they are registered users or anonymous visitors. This Policy forms an integral part of the Company’s Privacy Policy and should be read in conjunction with it, as well as with the Company’s Terms and Conditions.

By continuing to browse the website after the cookie banner has been displayed, or by expressly accepting cookies through the consent management mechanism, the visitor confirms that they have read and understood the terms of this Policy. In respect of cookies that require consent, that consent may be withdrawn at any time in the manner described in Article 6 of this Policy.

Article 2. What Cookies Are

A cookie is a small text file that a web server sends to the browser on a visitor’s device when they visit a webpage, and which the browser stores on the visitor’s device. On each subsequent visit to the same website, the browser returns this file to the server, thereby enabling the server to recognise the device and to remember certain settings or information.

In addition to traditional cookies, similar functions may be performed by pixel tags, web beacons, local storage and similar technologies. In this Policy the term “cookies” is used collectively for all such technologies unless expressly stated otherwise.

Cookies may be session cookies, which are deleted when the browser is closed, or persistent cookies, which remain on the device for a defined period determined by their expiry date.

Article 3. Categories of Cookies Used by the Company

3.1 Strictly necessary cookies

Strictly necessary cookies are technically required for the basic operation of the website. They enable navigation through the website, access to secure areas of the website and basic functions without which the website would not operate properly. These cookies do not collect personal data for marketing purposes and cannot be disabled.

Examples of strictly necessary cookies include: cookies for the session security token that protect the contact form from misuse; cookies that remember the website language settings; and cookies that store the technical settings of the browser session.

Legal basis for processing: the Company’s legitimate interest in ensuring the technically correct operation of the website.

3.2 Functional cookies

Functional cookies enable the Company to remember choices made by the visitor, such as language or region settings, in order to provide a personalised and more convenient browsing experience. These cookies do not track the visitor’s activity on external websites.

Should a visitor disable functional cookies, certain features of the website may not operate correctly or may be unavailable; however, the core content of the website will remain accessible.

Legal basis for processing: the visitor’s consent.

3.3 Analytical cookies

Analytical cookies collect information about how visitors use the website, for example which pages they visit most frequently, how long they remain on a particular page and whether they receive error messages. All information collected through these cookies is aggregated and anonymised and is not used to identify individual visitors. The Company uses this information solely for the purpose of improving the operation and content of the website.

The website may use the Google Analytics service provided by Google LLC, which operates with its own cookies. Information generated through these cookies may be transferred to Google servers in the United States of America or in another country. Google processes this information in accordance with its own terms of service and privacy policy. A visitor may disable the use of Google Analytics by installing the browser add-on available on Google’s website.

Legal basis for processing: the visitor’s consent.

3.4 Marketing and tracking cookies

Marketing cookies are used to track visitors across different websites for the purpose of displaying relevant advertisements or content tailored to their interests. As at the date on which this Policy enters into force, the Company does not use marketing or third-party tracking cookies on the website https://fms.mk/. Should the Company introduce such cookies in the future, this Policy will be amended accordingly and visitors will be asked to provide fresh consent.

Article 4. Third-Party Cookies

Certain content on the website, such as embedded videos or maps, may originate from third parties, and by displaying such content on the visitor’s device those third parties may set their own cookies. The Company has no control over these cookies and their use is governed exclusively by the privacy policies of the relevant third parties. Visitors are advised to review the privacy policies of those third parties.

As at the date on which this Policy enters into force, the website may contain embedded content or functionality provided by: Google LLC (embedded maps and/or videos) and YouTube LLC (embedded videos). Each of these services operates under its own cookie and privacy terms issued by its provider.

Article 5. Cookie Duration

The duration of a cookie depends on its category and purpose. Session cookies expire and are deleted automatically when the browser is closed. Persistent cookies remain on the visitor’s device after the browser is closed and last until their expiry date or until they are deleted manually.

Strictly necessary cookies are as a rule session cookies or have a short duration of no more than 24 hours. Functional cookies may last for up to 12 months. Analytical cookies, including Google Analytics cookies, may last for up to 24 months. Should the visitor clear their browser history or install a new version of their browser, all cookies present on the device will be deleted.

Article 6. Cookie Management and Withdrawal of Consent

The visitor may control and manage cookies in several ways.

On the first visit to the website, the visitor will be shown a cookie banner offering them the option to accept all cookies, to decline non-essential cookies or to customise their settings by category. The visitor may change their settings at any time by clicking on the relevant cookie management link available on the website.

In addition to the website’s consent mechanism, the visitor may also control cookies directly through the settings of their browser. All modern browsers offer the facility to view, delete and block cookies. The visitor should consult the instructions for their particular browser for detailed guidance. Blocking all cookies, including strictly necessary cookies, may cause certain parts of the website to malfunction.

The withdrawal of consent in respect of analytical or functional cookies shall not affect the lawfulness of any processing carried out on the basis of consent previously given.

Article 7. Effect of Disabling Cookies on Website Functionality

Disabling strictly necessary cookies may cause the website to malfunction, the contact form to become unavailable or certain content to fail to display. The Company accepts no liability for the limited or incorrect functioning of the website that results from the cookie settings chosen by the visitor.

Disabling functional or analytical cookies has no effect on the basic accessibility of the website’s content.

Article 8. Processing of Personal Data Through Cookies

To the extent that cookies collect or process personal data, such processing is governed by the Company’s Privacy Policy, available on the website. Technical log files and data collected through analytical cookies are stored in anonymised or aggregated form and do not permit the identification of a specific individual, except where this is technically necessary and legally permitted.

Article 9. Amendments to the Cookie Policy

The Company reserves the right to amend this Policy at any time, for example due to changes in the technologies used, changes in applicable law or the introduction of new website functionality. The amended Policy shall be published on the website and shall take effect on the date of its publication. Where amendments relate to cookies that require consent, the visitor will be invited to express their consent afresh upon their next visit to the website.
